INDEMNIFICATION AND INSURANCE REQUIREMENTS

INDEMNIFICATION

To the fullest extent permitted by law the LEASEE/RENTER shall indemnify and hold harmless Hydro-Engineering, Inc. from and against all claims, damages, losses and expenses, including but not limited to attorney fees, arising out of and resulting from LEASEE’s rental of and use of, whether intended and/or expected, the items described as follows:  Water blasting equipment and or accessories, under rental contract number____________.

INSURANCE

The LEASEE/RENTER shall maintain during the term of the rental agreement insurance in a company acceptable to Hydro-Engineering, Inc. with minimum limits as shown below.

 

A.                Comprehensive General Liability on an occurrence basis providing a combined single limit for bodily injury and property damage of $1,000,000.00 each occurrence.  The policy must include Hydro-Engineering, Inc. as an Additional Insured and a Waiver of Subrogation in favor of Hydro-Engineering, Inc. and must provide Premises/Operations, Products/Completed Operations, Independent Contractors, Broad Form Property Damage and Contractual Liability.

 

B.                 If use of rented items covered under this agreement is by person or persons subject to the Workers Compensation laws of the State of Texas Workers Compensation providing statutory limits and at least $100,000.00 Employers Liability with a Waiver of Subrogation in favor of Hydro-Engineering, Inc.

 

C.                Commercial Automobile Liability for use of owned, non-owned and hired autos providing a combined single limit of liability for bodily injury and property damage of $1,000,000.00.

   

D.                Property Insurance for the full actual cash value of the item(s) leased/rented against all risk of physical loss applying at the time the LEASEE/RENTER assumes physical possession and responsibility for the item(s) until the item (s) is returned or responsibility relinquished including while in transit, in use, in storage, whether on land, airborne, or waterborne.  Should the LEASEE/RENTER assume full responsibility under this agreement?

 

E.                 A Certificate of Insurance on an approved form must be delivered to Hydro-Engineering, Inc. prior to the transfer of physical possession to the LEASEE/RENTER sub-lease/rent the item(s) to another, LEASEE/RENTER assumes full responsibility under this agreement

 

F.                 A Certificate of Insurance on an approved form must be delivered to Hydro-Engineering, Inc. prior to the transfer of physical possession to the LEASEE/RENTER and must state coverage will not be altered, canceled, or allowed to expire without 30 days written notice to Hydro-Engineering, Inc.

A non-refundable deposit of a $100.00 per day will be charged until an acceptable Certificate of Insurance is provided.

I agree to provide Hydro-Engineering, Inc. with the above requested insurance coverage.  I also understand that I am contractual liable to provide this insurance coverage.
